dc.descriptionSelf-determination is a legal concept that refers to the possibility of a person to be considered a member an indigenous group, according to what it is stated under the Mexican Political Constitution. However, it is the State that continues to hold the power to determine and provide the characteristics of who can be considered indigenous. Although the second article establishes and provides the right for self-determination for the indigenous people and their communities, The Mexican State maintains a monistic legal tendency, in which only the state can determine, whom the legal norms apply to, all this in spite of multiculturalist rhetoric in front of the national legislation.en-US
dc.descriptionLa autoadscripción es un concepto jurídico que alude a la capacidad de una persona a considerarse parte de un grupo indígena, lo anterior de acuerdo a lo establecido en la Constitución Política de los Estados Unidos Mexicanos. Sin embargo, es el propio Estado quien sigue manteniendo el poder único para delimitar las características objetivas de quién deberá considerarse indígena. Aunque el artículo segundo establece el respeto a la autodeterminación de los pueblos y comunidades indígenas, el Estado Mexicano mantiene una tendencia jurídica monista, en la cual solo él determina cuáles, y para quién son las normas jurídicas, todo esto a pesar de plantear un discurso multiculturalista en la legislación nacional.es-ES
